Terms and conditions for the Head and Shoulders competition

This is an online and postal Promotion offered by Head & Shoulders, Hair Care division of Procter & Gamble.

1. Who can enter
The Promotion is open to residents of the UK only aged 18 and above [NB: No valid agreement to the T&Cs can be obtained from under 18]. Entrants under 18 on 6th February 2012 should obtain written permission from their parent or guardian and produce such permission to Asda if required. No third Parties or bulk entries. The application is not open to employees of Procter & Gamble or Asda Stores Ltd [its affiliate or subsidiaries] nor their immediate families or persons living in the same household of such individuals. The Promotion is subject to all applicable laws and regulations of the United Kingdom. The Promotion is void where prohibited or restricted by law or regulations.

2. How to enter the Promotion
Applicants can either enter by visiting the Your Asda Post and following instructions or by sending their name, address, phone number and email address to Big Apple Promotion, Golley Slater, Richmond House, 5-8 Richmond Terrace, Otley Road, Guiseley, Leeds LS20 8BP. No purchase necessary.

3. Entry details
(a) The Promotion begins at 12am on 27th July 2012 and ends at 11.59pm on 10th August 2012. All entries must be uploaded by 11.59pm on 10th August 2012 All postal entries must also be received by 11.59pm on 10th August 2012.
(b) The Promotion is limited to one entry per person.

4. Details of Prize:
The first Prize for one winner is a weekend for two in New York. The prize includes return flights, taxi from the airport to hotel, 3 nights stay at a 4 star hotel in a twin or double room and £200 spending money. The winner will also get 20 250ml bottles of Head & Shoulders Apple Shampoo.

Ten runners up will each win 10 bottles of 250ml bottles of Head & Shoulders Apple Shampoo.

(a) The competition is at the discretion of Procter & Gamble for final prize. This will be dependant on stock availability at time of draw and P&G have the right to amend the brand of the prize;
(b) No cash alternative is available;
© Winners will be notified of their win by email or telephone within 7 working days of the closing date; 21.08.12. In the event a claim for a prize is not received by the Promoter within 10 working days of such notification, the Promoter reserves the right to select an alternative winner. Please allow 28 days for delivery; 29.09.12.
(d) Winners’ names and county of residence will be published by the Promoter after the closing date at the following link: www.facebook.com/asda. For a full list of winners, send an SAE to: Golley Retail, Big Apple Promotion, 5-8 Richmond Terrace, Otley Road, Guiseley, Leeds LS20 8BP, after the closing date.
(e) All winners will be chosen at random from all entries received.

5. Data Protection
By submitting your data in this Promotion you give your consent to Asda as data controller to collect and process your personal data for the purpose as you provided your consent below, for an unlimited period of time or until you opt out via on online enquiry. Procter & Gamble and Asda shall handle your personal data in accordance with the applicable Data Protection Act. Furthermore you agree and accept that Asda may transfer your personal data to other companies of the Asda Group. You agree that your personal data may be stored and processed by the data controller’s entrusted data processors within or outside of your country. 6. Rules of Entry
This Promotion is for your personal entertainment and we expect you to enjoy it while abiding by the following rules:

(a) By entering the Promotion, you agree to be bound by these Terms & Conditions. Procter & Gamble reserve the right to modify the content of these Terms & Conditions with retrospective effect for the sole purpose of ensuring the good execution of the Promotion, with no detrimental effect on the participants.

You agree that entry into this Promotion shall be at your sole risk. To the fullest extent permitted by law, Procter & Gamble, its officers, directors, employees, and agents make no warranties or representations about the accuracy or completeness of the content of www.asda.com/headandshsoulders or the content of any sites linked to this site and assumes no liability or responsibility for:

(i) any errors, mistakes, or inaccuracies of content;
(ii) and property damage of any nature whatsoever, resulting from your participation in the Promotion;
(iii) death or personal injury resulting as a direct result of entry into the Promotion, unless caused by the negligence of Procter & Gamble, its officers, directors, employees, and agents;
(iv) any interruption or cessation of transmission to or from Your Asda Post
(v) any bugs, viruses, or the like which may be transmitted to or through Your Asda Post by any third party; and/or
(vi) any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via Your Asda Post

By entering the Promotion, you agree to defend, indemnify and hold harmless Procter & Gamble, its directors, employees and agents, from and against any and all claims, damages, losses, liabilities, costs or expenses (including but not limited to legal fees) arising from: (i) your use of and access to Your Asda Post ; (ii) your breach of any of these terms; (iii) your breach of any third party rights, including without limitation any copyright, property, or privacy right; or (iv) any claim that any one of your submissions caused damage to a third party. This indemnity shall survive the duration of the Promotion.

(ix) Jurisdiction
This Promotion shall be governed by the laws of England, Scotland and Wales and subject to the exclusive jurisdiction of the Courts of England, Scotland and Wales] over any claim or matter arising under or in connection with the Promotion.
